Functions of the Department:
Direction of Contract Examination
- Legal examination of draft international agreements in order to determine compliance with the legislation of Georgia and preparation of the relevant legal opinion;
- Legal examination of draft loan and international grant agreements in connection with the borrowing of foreign debt in order to determine compliance with the legislation of Georgia and preparation of the relevant legal opinion;
- Legal examination of draft administrative agreements in order to determine their compliance with the legislation of Georgia and to assess the legal risks in them, the value of which exceeds one million GEL and / or which provide for the settlement of disputes between the parties by arbitration or a foreign court;
- Enterprises holding a controlling stake or more than 50 percent of the shares shall be subject to legal examination of draft agreements to determine their compliance with Georgian law and to assess the legal risks involved in resolving disputes between the parties through arbitration or arbitration by the foreign county court;
- Preparation of drafts of international agreements within the competence of the Ministry, including international agreements on mutual legal assistance;
- Confirmation of the implementation of the procedures related to borrowing of state debt and state guarantees on loans, as well as the procedures related to the conclusion of international grant agreements in accordance with the legislation of Georgia (Legal Opinion);
- Development of proposals for concluding, suspending and terminating international agreements on issues within the competence of the Ministry;
- Participation in negotiations related to international agreements (loan, investment) projects;
- Participation in the preparation of policies and / or specific legislation by the government on investment, private international law and contract law in general;
- Participation in various inter-agency commissions, councils and working groups.
Direction of Court Representation and Review of Administrative Applications
- Providing representation of the Ministry in the common courts of Georgia and in the Constitutional Court of Georgia (study of case materials; formulation of legal arguments; preparation of lawsuits, counterclaims, appellate and cassation appeals, and submission to the court);
- Analysis of court disputes related to issues within the competence of the Ministry;
- Consideration of administrative applications related to the issues within the competence of the Ministry in accordance with Chapter XIII of the General Administrative Code of Georgia (from the stage of making a complaint to the final decision, organizing the administrative proceedings, preparing the session, preparing the minutes, drafting various administrative-legal acts);
- Ensuring that the Ministry provides legal assistance to other administrative bodies, including participation in a working group of various inter-agency experts set up by the Government of Georgia.
